LINCOLN, Neb. (KOLN) - A Winnebago man was sentenced for assault on Thursday.

The Department of Justice announced that 36-year-old Gabriel Lee Rice was sentenced in federal court in Omaha for assault resulting in substantial bodily injury. A U.S. district judge sentenced Rice to 2 years and 6 months in prison. There is no parole in the federal system.

After Rice’s release from prison, he will begin a 3-year term of supervised release.

According to the DOJ, in July 2022, Rice assaulted a woman known to him, pinning her against a wall, then covering her mouth and nose with his hand. Rice restricted the woman’s breathing to the point that she fell unconscious.

The DOJ said the assault occurred in front of a child.

The case was prosecuted in federal court because the offense was a felony and occurred on the Winnebago Indian Reservation in Nebraska.

This case was investigated by the Federal Bureau of Investigation.
